Judgment records in South Africa
Judgment on your credit report? Understand your next steps.
A court order and a bureau record are not the same thing. Understand the difference before you act.
A court order and a bureau record are not the same thing
A judgment is an order made by a court. It is a legal matter that exists independently of your credit report. A bureau record of that judgment is the information about the judgment held by the credit bureau.
This distinction matters because the two are addressed differently. Updating or removing the bureau record is an administrative matter with the bureau; rescinding the judgment itself is a court process that requires a court order. Understand how credit-record corrections and updates differ from a court process before choosing a next step.
A debt-rearrangement order is not interchangeable with a judgment for an individual unpaid account. Read the position after a debt-rearrangement order before assuming that a judgment-removal procedure also ends debt review.
A judgment debt has a different prescription category from many ordinary debts. Do not apply a three-year shortcut; see different prescription periods and obtain court-specific advice where needed.
This page provides high-level administrative information only. It is not a court application guide and does not represent that SA Credit Clear issues court orders or provides legal services.
When a judgment debt has been paid
Paying a judgment debt is an important step, but it does not by itself rescind the court order. The bureau record should be updated to reflect the paid status, and you should keep proof of payment and the court documents.
Keep paid-up status versus retained credit history distinct when reviewing information after payment - a paid status is an update, not a deletion of the record of the judgment.
Documents to identify and check
First, check that the entry is actually a judgment, rather than a default listing or another type of account information. The documents that may help include:
- The court order or case reference
- Proof of payment or settlement of the judgment debt
- Correspondence with the creditor or their attorneys
- Proof of identity for a bureau query
When qualified legal help is needed
Rescinding a judgment is a court process and may require an appropriately qualified legal professional. SA Credit Clear provides administrative support and information about the record - not legal representation. You can ask about an assessment while directing legal questions to an appropriately qualified professional.
For home buyers, checking paid-up records before a bond application is one part of preparation, not a guarantee of approval.
